Terms and withdrawal
For atelier orders and design commissions

1. Scope
These terms apply to contracts between Tinta Mondo Studio, [full name], [address] (“I”) and you as customer for posters, art prints and design services (print, web, animation).
2. Contract
The atelier pages are an invitation to enquire, not a binding offer. You write to me, I confirm availability, price and shipping, and the contract is formed when you accept my offer. Design commissions start with a written quote that you confirm.
3. Prices and payment
All prices in euros. [Either: including statutory VAT] or [small-business rule, § 19 UStG: no VAT shown]. Shipping costs are stated in the offer. Payment by [bank transfer / payment link] within [14] days. A deposit can be agreed for design commissions.
4. Delivery and retention of title
Posters and prints ship after payment; the delivery time is stated in the offer ([approx. X working days]). Goods remain my property until paid in full.
5. Right of withdrawal for consumers
You may withdraw from the contract within 14 days without giving a reason. The period starts when you receive the goods. A clear statement by email to emily.ibler@tinta-mondo.de or by post is enough. After withdrawal I refund the payment including standard shipping within 14 days of receiving your notice; you bear the return costs. The goods must come back undamaged.
No right of withdrawal applies to goods made to your specifications or clearly tailored to you (for example bespoke designs, commissioned works or personalised prints) and to services I began at your express request before the period ended.
6. Cancellation
You can cancel orders free of charge until they ship. For design commissions, I charge work already done pro rata.
7. Rights of use
Paintings, prints and designs remain my copyright. Buying a print gives you ownership of the copy, not the right to reproduce it. For design commissions I grant the rights of use named in the offer after full payment. My source files and drafts are not included unless expressly agreed.
8. Warranty
Statutory warranty rights apply. Small differences in colour, paper texture or embossing are part of handmade work and screen display and are not defects. Please report transport damage within 7 days with a photo.
9. Liability
I am fully liable for intent, gross negligence and injury to life, body or health. For slight negligence I am liable only for breach of essential contractual duties and limited to foreseeable, typical damage.
10. Data protection and final provisions
How I handle your data is described in the privacy policy. German law applies, excluding the UN Sales Convention; mandatory consumer protection of your country of residence also applies. If a provision is invalid, the rest remains effective.
11. Dispute resolution
I am neither willing nor obliged to take part in dispute resolution before a consumer arbitration board.
